2. How we collect information
We collect information:
- directly from you when you complete a form, book a call, telephone or email us, approve work or use our services;
- automatically through hosting, security logs and, where permitted, cookies or similar technologies;
- from referral partners, public business sources or somebody acting on behalf of your organisation; and
- from advertising and analytics platforms when you interact with our adverts or website and the required consent has been obtained.
3. How and why we use information
UK data protection law requires us to have a lawful basis for each use of personal information. We use it:
- To answer enquiries and arrange free calls: to take steps at your request before entering a contract and for our legitimate interest in responding to prospective customers.
- To quote, contract for and deliver our services: to perform our contract with you or to take steps before entering it.
- To manage customer relationships and support: to perform our contract and for our legitimate interest in running an effective service.
- To invoice, collect payments and keep records: to perform our contract, comply with legal obligations and protect our legitimate business interests.
- To operate, protect and troubleshoot our website: for our legitimate interests in security, fraud prevention, service reliability and defending legal claims.
- To understand and improve our website: for our legitimate interests where the information is essential or aggregated, and with consent where non-essential analytics technologies are used.
- To measure adverts, personalise marketing or build advertising audiences: with consent where required by privacy and electronic communications law.
- To send business marketing: with consent where required, or otherwise where permitted by law and in our legitimate interest. You can opt out at any time.
- To comply with the law: where processing is necessary for a legal obligation.
Where we rely on legitimate interests, we consider whether our use is necessary, proportionate and fair, taking your rights into account.
4. Forms, cookies, analytics and advertising
Our enquiry forms may be processed by Formspree on our behalf. Our website may be delivered and protected using Cloudflare. If we enable non-essential analytics or advertising tools, such as Google Analytics or advertising tags from Google, Meta or TikTok, we will provide an appropriate consent choice before those tools operate where the law requires it.
The Google Map on our contact page is not loaded until you choose to load it. Loading it connects your browser to Google, which may receive technical information and use cookies. See our Cookie Policy for more detail.
5. Who we share information with
We only share personal information where reasonably necessary. Recipients may include:
- Cloudflare and other hosting, security, domain or infrastructure providers;
- Formspree and other form, email, communications or customer support providers;
- payment, banking, bookkeeping and accounting providers;
- Google, Meta, TikTok or similar analytics and advertising providers, if their tools are enabled and the required consent has been obtained;
- professional advisers, insurers, contractors and suppliers who are subject to appropriate duties; and
- regulators, courts, law enforcement, public authorities or a buyer of our business where disclosure is legally required or reasonably necessary.
We do not sell your personal information.
6. International transfers
Some service providers may process information outside the United Kingdom. Where this is a restricted international transfer, we use a lawful transfer mechanism such as UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses or another safeguard permitted by UK law. You can contact us for more information about the relevant safeguards.
7. How long we keep information
We keep personal information only for as long as reasonably necessary for the relevant purpose. Normally:
- enquiries that do not become customers are kept for up to 24 months;
- customer, contract, invoice and service records are kept during the relationship and normally for up to seven years afterwards for tax, accounting and legal purposes;
- marketing records are kept until you opt out or they are no longer needed, while a minimal suppression record may be retained so we respect your opt-out;
- technical, analytics and advertising information is retained according to our settings and the relevant provider's retention controls; and
- backup copies are removed through our normal backup cycle.
We may keep information longer where required by law, a regulator, a dispute or a legal claim.
8. Security
We use appropriate technical and organisational measures intended to protect personal information from loss, misuse, alteration or unauthorised access. Access is limited to people and providers who need the information for their work and are subject to suitable obligations. No internet service can be guaranteed completely secure.
9. Your rights
Depending on the circumstances, UK data protection law may give you the right to:
- ask for access to your personal information;
- ask us to correct inaccurate or incomplete information;
- ask us to erase information;
- ask us to restrict how information is used;
- receive certain information in a portable format;
- object to processing based on legitimate interests or for direct marketing; and
- withdraw consent at any time, without affecting processing carried out before withdrawal.
You can ask us to stop using your information for direct marketing at any time by contacting us or using an unsubscribe option in a message.
These rights are not absolute and legal exemptions may apply. We may need to verify your identity. We normally respond within one month and do not charge a fee unless a request is manifestly unfounded or excessive.
10. Complaints
Please contact us first so we can try to resolve your concern. You also have the right to complain to the Information Commissioner's Office (ICO), the UK data protection regulator, through ico.org.uk.
11. Automated decisions and children
We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects. Advertising providers may use consented information to measure or personalise advertising. Our services are intended for businesses and are not directed at children.
12. Third-party links
Our website may link to other websites. Those organisations are responsible for their own privacy practices, and we recommend reading their privacy notices.
13. Changes and contact
We may update this notice when our services, providers or legal obligations change. The date at the top shows when it was last updated. Contact us at hello@klickshot.co.uk with questions or rights requests.
